Consignment Declaration & Terms — The Muse Edit

At The Muse Edit (“Muse”, “we”, “us”), transparency and trust are at the heart of every consignment. This page explains how consigning your luxury items with us works, what you agree to when you submit a piece, and what you can expect throughout the consignment process.

1. Submission & Review

When you submit an item for consignment using the Quote Submission form, you provide details and images so we can assess it for suitability. Every submission is reviewed on a case-by-case basis.
We may request additional documentation if needed.

Items that do not meet our standards, or lack credible information, may be declined. Declining a submission does not imply judgment of value — it ensures we only offer items that meet Muse quality expectations.

2. Acceptance & Offer

If your item meets our criteria, you will receive a formal offer via email — typically within 24 hours of acceptance.
You are under no obligation to accept this offer.

Once you accept, the consignment process begins.

3. Ownership & Title

Ownership of your item remains with you (the consignor) until Muse successfully sells it to a buyer.
Only after the item sells does legal ownership transfer to the buyer.

This protects you and ensures your rights are maintained throughout the consignment period.

4. Pricing & Commission

Muse will recommend a selling price based on condition, desirability and current market trends.
Your offer and pricing structure will be clearly outlined before listing.

Our commission (and any additional agreed fees) will be deducted from the final sale price. You will receive full transparency in writing before any sale listing goes live.

5. Risk & Care

While your item is in our possession, we take reasonable care to store and present it professionally.
However, you acknowledge that no storage or retail environment is entirely risk-free.

You may choose to insure your item at your discretion, particularly for high-value pieces.

Muse is not liable for loss or damage outside our control once your item is delivered into our possession — this is standard practice in consignment agreements.

6. Consignment Period

Your item will be listed for an agreed consignment period.
If the item does not sell within this timeframe, we will contact you with options:

  • Extend the consignment period

  • Return the item

  • Consider a new price strategy

7. Early Withdrawal

You may request to withdraw your item from consignment at any time before it sells.
Please note that early withdrawal may incur a fee if preparation work (photography, authentication, listing) has already been completed.

8. Unauthentic or Disputed Items

By submitting an item, you warrant that:

  • The item is authentic

  • You have full legal title to consign it

  • It is not stolen, subject to dispute, or encumbered

If any of these warranties are found to be untrue, you agree to indemnify Muse from any resulting loss, costs or claims.

9. Legal Compliance

Muse operates fully within Australian Consumer Law and other applicable regulations related to second-hand goods. Our practices are designed to meet commercial standards for consignment sales and consumer protection.

Where appropriate, consignors may register a security interest under the Personal Property Securities Register (PPSR)to further protect their rights in high-value situations — additional legal advice may be sought for PPSR registration.

10. Tax & Reporting

Consignor payments and proceeds may have tax implications, including GST where applicable. It is your responsibility to consult with a tax advisor regarding obligations under Australian tax law.

Muse may provide documentation (such as sale receipts) to assist with your tax reporting.
